Reported accident to insurance but not police now court

    Hi all,

    so at the start of April I reversed into a parked car. I rent a cottage on a country estate and it's a mile to house within the estate.

    I reported the accident to my insurance as didn't have a pen and paper in the car so went home to get some and came back and car had gone. there were no witnesses at the time to report the accident to either hence reported it to my insurance.

    insurance company never got a claim back till December stating what damage had occurred.

    iv now been summoned to court for failing to report a accident (granted I genuinely didn't realise unless someone was injured it had to go to the police) , driving without due car And attention and failure to stop after accident.

    iv had a clean license for over 20 years. I hold my hands up to hitting the car hence why I went through insurance. when the police sent a form asking if there had been a accident I said there had but no damage reported and in hands of insurance company which was the case as nothing was claimed for 4 months.

    what is the likely outcome of my pending court case as I say no points or speeding offences clean license. I admit I hit the car and didn't report it to the police but was reported to insurance.

    a witness did witness it but when I got out the car no one else was around as she stayed in her car as it was dark count see her.

    In 1980, a long time ago I know, but bear with me, I saw a car hit another on a slip road onto the M40. It was around 1.30am, and very poorly lit. The car that was hit had broken down and was showing no lights. The car that hit it sped off, and I couldn't identify it. I stopped with the intention of leaving my details with the driver. It was a middle-aged woman and she was alone and badly shaken. She told me her husband was on his way and that it wasn't necessary for me to stay. I drove off.
    About a week later I had a visit from the Police asking for a statement. I told them what I had seen, and signed my statement. They told me that my version of events did not tally with the statement the women had given, and advised me that a Court Summons would probably be on the way. Sure enough I received a Summons for Driving without Due Care and Attention. In court, the lady was adamant that I had been the one that had hit her car and despite my explanation, the decision went against me, and as well as a fine, I was given 2 endorsements for a motorway offense and the DWCAA. (This was before points.) That really stung, but it was made worse when my appeal was rejected.
    My point being that anything could happen in Court, and I strongly recommend finding a solicitor who specializes in motoring law.

    A bit late now, but did you ask her how she had contacted her husband?

    Apparently, she used the Emergency box, and the Police contacted him. The Police had paid her a visit, but at her request, they had given her husband time. They had explained that if she was still there later when they checked, they would arrange recovery at her expense. I used part of this to explain how she was already a bit flustered before the collision, explaining her confusion about who had hit her. Obviously to no avail.

    Obviously you will need legal representation who is familiar with motoring matters.

    Your story has a bit missing that I think will be important.

    When you went for pen, and paper had you spoken to the other party, and had they told you there were injuries?
    Remember, whiplash may not show until the following days.

    Otherwise, it looks like a case of misunderstandings, hopefully it will be sorted out in court.
