Sorry no one has responded before - If the car was from a dealer the car had a 6 months warranty.
However, I am not sure there is any restriction on where the parts come from to do any repairs under that warranty.
I think you are going to need some legal assistance to get a full refund, as it can be construed you prevented the dealer repairing the car in objecting to second-hand parts. -
@olduser That's a contentious issue here. BMW for one insist that you only use genuine BMW repair panels for body repairs. If you don't the warranty is void, but the insurance companies want the body repair shops to use the cheaper aftermarket or junkyard parts to save money, voiding the warranty, and the owner has no idea until he makes a warranty claim for something totally unrelated and it's rejected.

@NMNeil
Here they’re supposedly not allowed to refuse warranty on something because you voided the warranty of a totally unconnected part. For example changing the seats wouldn’t the engine warranty.
Is it different there?
I know that’s probably a relatively useless law as it’d be easy to wriggle out of it. Plus I suppose one could contrive an explanation for any two parts of a car having some kind of connection. 😕 -
I think this answers your question/s.
It was another one of those terrible bits of legislation passed by the EU.😏
"Under EU legislation, there have been important changes to the rules surrounding car warranties and servicing, particularly with the aim of promoting competition and consumer rights.
Key points regarding replacement parts and warranties:
1. Right to Service Your Car at Any Garage:
EU law now explicitly states that car owners have the right to have their vehicle serviced or repaired at any independent garage without voiding the warranty, provided the service or repairs are performed correctly and according to the manufacturer's specifications.
2. Use of Original or Equivalent Parts:
When a vehicle is serviced or repaired under warranty, manufacturers cannot mandate the exclusive use of their original parts. Instead, independent garages can use suitable, equivalent spare parts that meet quality standards. This means that you are not forced to buy expensive OEM parts from the manufacturer if equivalent parts are available and meet safety and quality requirements.
3. Replacement Parts During Repairs:
- Warranty on Replacement Parts: Replacement parts used during repairs are generally covered under warranty for the same period as the vehicle’s warranty, unless specified otherwise.
- Compatibility and Quality: The replacement parts should be of comparable quality and compatible with your vehicle. Using inferior or non-compliant parts could void the repair warranty.
4. Manufacturer’s Conditions and Transparency:
Manufacturers must clearly communicate warranty conditions, including what parts can be used and how repairs should be performed to maintain warranty coverage.
Summary:
The EU law reinforces your right to have your vehicle serviced and repaired at any authorized or independent garage, using original or equivalent quality parts, without losing warranty coverage. Always keep records of repairs and parts used to ensure warranty validity." -
@Drivingforfun " An Authorised BMW Centre or BMW Service Authorised Workshop using only genuine BMW Parts must carry out all service and warranty work. The BMW Service Booklet should also be stamped, dated and detailed with the correct mileage at the time of service by the servicing BMW Centre"

Most manufacturers have similar T&C but it is a bluff.
Where cases have gone to court car manufacturers have lost, what tends to happen now is they try to hide behind the T&C if it looks as though the customer will go to court, they buy them off.
But of course your average Jane or Joe (mustn't be sexist), will not be prepared to risk going to court.
