Roundabout accident

    Hi

My husband was involved in an accident. He was in the middle lane of a 3 lane roundabout. Left hand lane is straight on only, middle lane is straight on or right hand and right lane is right only. He was hit by a car on his left which collided with our rear passenger door. The damage to the car suggests that their car hit head on which matches with their passenger informing my husband they were turning right. They are disputing liability, we haven't heard their version of events. There are no witnesses, no dashcam but we do have a video of discussions after the accident in which they acknowledged that the passenger had said they were turning right.

They must have been slightly behind because they turned into my husbands car rather than cutting in front of him so the damage is towards the back of our car and the front of theirs. I have read that a lot of these cases are 50/50 but my husband was in the right lane, going in the right direction and they were in the wrong lane and turned into his car. How do insurance companies determine fault in these cases? Surely the damage on our car would support our record of events. I have absolutely no idea what the other party have claimed happened.

    Hi SF86,

Welcome to the RAC Community - I'm glad that your husband is ok.

I'm not an expert, but if i've understood correctly, it sounds like the other party was in the wrong lane/assumed they could go straight on and collided with the side of your husbands car when he didn't drive in the direction they expected.

If the evidence after a collision doesn't match with their description, I imagine they'll be in more trouble than it is worth. IMHO, the best thing to do is let the insurance company take care of things, be patient and hand over all the info/recordings that you have.

It can be frustrating going through this process, it's always worth remembering that it was only a machine that was damaged.
