Mobile Speed camera check

    Dear all,
    I passed a mobile speed camera today. It was 60 mph Road and driven the same speed. But unfortunately I have overtaken a car front of me which was very slow driver. So I just overtaken by small area of white crossing road and realised there was the mobile speed camera van. I was very confused and worried could I be under penalty points or not. Could anyone advise me. Mobile speed camera van checks drive over white crossings or not. Kindly accept any grammar error and advise me. I’m so worrying about it

    So let me get this straight?

    Was the camera van stationary or moving?

    You were driving at the legal limit - 60 which is not a problem.

    Are you suggesting that you overtook on a central solid white line system?

    If that is the case, then that is a different issue. First of all, a solid central white line does not mean that you cannot overtake, it simply means that you are not allowed to cross over or straddle the centre white line except under certain circumstances.

    If that is what you are referring to, then that is where the issue might lie.

    Firstly, it does not need a camera to record you committing the offence, it only has to be observed by someone deemed to be an expert and the camera van operator falls into that category.

    So all you can do is wait a couple of weeks and see if the dreaded NIP (official notice of intended prosecution) drops through the letterbox.

    If the Police are considering prosecuting you, then the NIP has to be sent in sufficient time to be reasonably assured that it will arrive within 14 days of the date of the alleged offence.

    If it takes longer than 14 days, then you have a statutory defence (depending on the dates on the document and the postmark on the envelope) so all you can do is wait and see.

    Assuming I have understood your post correctly, don't lose any sleep over it, it is not the most heinous traffic offence, although it will involve points and a fine if convicted.

    If I have misunderstood what you have written, please accept my apologies and maybe clarify the ppints I have got wrong or misunderstood?

    @TC1474 thank you so much for your response about my query. I believe I was driven by white crossing road and overtaken in legal way (white dots lane) when I was driving over the white crossings I was realised there was a van which is temporary speed check van. That’s why I was confused would they checking the driving over the white crossings. If it is not issue I’m blessed. Anyway I’ll wait and update you after 2 weeks.

    If you were within the speed limit and you were overtaking on a broken central white line system, then all is good, so whether a speed enforcement van was there or not doesn't matter.

    They can only enforce and report for offences committed. Based on what you have said, no offence was committed, so no enforcement, therefore no worries..
