Possible speeding fine ….

    Hi all

    local to home on a 20mph road was doing around 35mph and braked on seeing officer with gun pointed straight at me around a bend. There was one other officer and a car but wasn’t stopped and didn’t notice if they were pcso either….thought I’ve been caught and was stupid to do so. I thought that’s it the fine will arrive in the post in the next week but to date have had nothing at all.
    date of offence was 9th October 24 and we are on day 18 today….can I just forget about it and see that as a warning?? Clean licence for 30 years and don’t actually make a habit of speeding. I understand the 14 day rule but I’m very much anxious about it just being late …..any ideas ?? Thanks

    When it comes to dealing with speed offences, there is a very strict protocol that has to be followed.

    If you were stopped at the time (which you weren't) then you must be given what is called a verbal NIP (Notice of intended Prosecution) which in simple terms lets you know that a decision will be taken in due course to determine whether you will be prosecuted or not.

    If you are given a verbal NIP, procedure is complete and you will either be given a fixed penalty or you will receive a summons through the post.

    If you were not stopped at the time but your offence was recorded, and assuming the Police decide to report you for the offence, then within 14 days from midnight of the day of the alleged offence, you must be sent a written NIP. So on that basis, 18 days on, if you have not received anything yet, then the chances are that it is not going to go any further. However....

    I would give it another few days. An NIP must be sent in sufficient time for it to stand a reasonable chance or arriving at the address of the R/O within 14 days, however given how unreliable the Post Office can be, or more to the point the haphazard way they deliver mail, providing it was sent before the 14 day expiry but failed to arrive it is deemed to have been served once it is in the mail system.

    Even then, if you get one, still check the date on the actual NIP itself. I have seen many where the NIP was dated 16+ days after the alleged offence and that immediately cancels out the NIP and any prosecution has to be dropped.

    @jacpilAre you the Registered Keeper? If you think you are, are the details on the V5C (logbook) up to date?

    Braking when you see the officer is generally too late. His speedmeter will probably be approved up to 999m, so he'll have seen you first.

    Finally, you say "on a 20mph road was doing around 35mph", but "don’t actually make a habit of speeding". Some mistake?

I hold my hands up at being irresponsible and bloody stupid really not paying attention. I hope that this was just a warning as tbh it’s kicked me up the ar*e but if not I will take the consequences. 👍

    I often think, a near miss does more to correct bad driving than any amount of fines etc.
    Or perhaps a good talking to, at the roadside by a policeman, what he has to say is so blindingly obvious, and common sense, you have to take it in, and the shear ignominy of standing at the roadside while everyone drives by, knowing full well what is going on, oh the shame of it, that will be remembered for years.

    Whereas a ticket, you pay, it hurts while you are paying but so what I got caught.
    Down the pub or back at work we can brag about it.
    And if you notice no one ever says I did wrong just, I got caught.

    very true….if this just turns out to be a warning it has certainly opened my eyes.
    BTW day 19 and still nothing in the mail….hoping for the better outcome but I will hold my hands up and say I did wrong.
