Who is at fault? Roundabout collision

    Hi there.

    Looking for a bit of peace of mind, having never been in an accident before. I was turning right at a 4 point roundabout. For explanations sake entrances are at 12 3 6 and 9 o'clock.

    I entered at 6 to exit at 3, as I was exiting 3 a car came out of 12 and scraped all along the front of my car. She did not see me coming and thought she got hit by a van of all things...

    I slammed on my brakes to stop most of the damage. My front left corner of the car is banged up. Her driver side is beat up from the front wheel arch to the rear door from where she scraped along my car.

    She tried to flee the scene, thankfully an off duty police officer pulled over to help keep here there and they called on duty police to support.

    I have photos, but she has already declared at the scene she will declare 50/50 liability to her insurer.

    My insurer have said they don't want photos as they are no good in court and that has me worried. Should I be? Nobody stayed as a witness unfortunately.

    This is very straightforward and she can claim what she wants but she is wasting her time

    Simply put, she failed to accord precedence to traffic from her right, and she will have failed to comply with a give way line/sign and then quote rule 185 which states


    • give priority to traffic approaching from your right, unless directed otherwise by signs, road markings or traffic lights
    • check whether road markings allow you to enter the roundabout without giving way. If so, proceed, but still look to the right before joining
    • watch out for all other road users already on the roundabout; be aware they may not be signalling correctly or at all
    • look forward before moving off to make sure traffic in front has moved off.


    You are on pretty solid ground.

    Did the Police report the other driver? Handy of they did, but I am not going to hold my breath, might have meant them doing some real work.

    I am not sure if they did to be honest, but they wouldn't let her drive herself home, one of them drove her car back if that means anything!
