Collision with Lorry on motorway who is at fault.

    Not my personal story but my brothers from today:

    I was driving on the 3rd (farthest right) lane on the motorway. A Lorry driving in the middle lane drifted into my lane. I saw the Lorrys wheel cross the line at beeped my horn. But the lorry hit the back left wheel of my car and I spun hitting the barrier.

    My engine and entire front of the car is wrecked, all airbags were activated. The only part of my car not damaged was the driver's door.

    I have no dashcam and the lorry driver said I was going to fast.

    I have asked for footage from the motorway live cameras but they said they don't store their footage.

    If it comes down to my word against the other driver does anyone know what might happen?

    I have photos of the damage to my vehicle and stills from the motorway camera but nothing showing the collision.

    So let me get this straight. Your brother was travelling in lane 3 of a Motorway overtaking a truck. The truck drifted over from lane 2 to lane 3, collided with your brother putting your brother into the barrier and put your brother into the central barrier and then claimed your brother was going to fast? 🙄

    Its a no brainer, truck driver is at fault.

    Was the truck driver overtaking a vehicle in lane 1? If not, why was he in lane 2?

    Trucks are limited to 52MPH (unless the governors have been illegally removed) so given that a 70 limit normally applies to a Motorway, how can he accuse your brother of going too fast?

    The truck drifted into lane 3. Trucks are prohibited from lane 3 of a Motorway, so any speed done by your brother is irrelevant.

    Why did the truck drift? (rhetorical question) Was the driver occupied doing something else? concentrating on doing other things? Falling asleep?

    Remember he is a so called professional driver (although many these days are anything but professional)

    I take it the Police attended? Be interesting to hear what their take on the matter is.

    I think your brother is on fairly safe ground as far as liability is concerned and any argument put forward by the driver as a defence should be quashed or discredited fairly easily, but your brother and the insurers need to stand their ground and if needs be, get your brothers insurance company to issue proceedings early on as this usually shows the defence that you are serious as regards to who you hold liable.
