Liability in a minor crash

    My partner who's a named driver was driving my car down a road that has cars parked either side.. he pulled over into a gap and was completely stationary to let another person through who was completely over both parts of the road. My partner was shouting to him to move over as he's close to our stationary car that we had left alot of room for him to get through as we were in a section where it's a lane coming off the main road he was on. He came shooting past about 15mph and he hit my car on the driver bumper leaving it with blue paint marks and black marks where it had come off my white car
    . You can tell by photo evidence that his car was the moving one as his car has a scrape marks going from his driver door through to the back where mine is just on the rear side bumper where my wheel is. Due to us being stationary and had pulled over giving him alot of ample room but he was too far over would he be the one that accepts the liability. We have his details e.g. and my insurance company said they will contact his but I'm worried it will increase my premium and have to pay excess for an incident that wasn't our fault.. should I contact his insurance company instead of mine? I have already notified my insurance company as I thought that's what I needed to do and they've booked my car in for repairs for 2 days time but should it be the other company doing that?

    The other driver will probably try to blame your partner, and it's up to the insurance companies to resolve. All you can do is to make sure that your insurance company has all the information you can get that makes the situation clear.

    You may have to pay the excess when you get the car repaired, but should (hopefully) be able to recover that from the third party's insurance. Sadly, it may well result in an increased premium regardless.

    I know this doesn't help the OP now, but a dashcam is a godsend in these situations.
