Stuck in standstill traffic on the m2. Turned off vehicle, hand brake on exited car to use phone.

Is there any specific law that says this isn't allowed because im being told multiple different things.

are you allowed to exit your car in these situations. Obviously it's not recommended due to filtering motorcycles/ emergency vehicles. But is there an actual law that says its illegal to do this.

The short answer is that there is no specific law to cover the circumstances you describe however...

The law is quite clear with regards to using a mobile whilst in the vehicle, specifically a hand held device cannot be used when -

• stopped at traffic lights
• queuing in traffic
• supervising a learner driver
• driving a car that turns off the engine when you stop moving
• holding and using a device that's offline or in flight mode

A jobsworth apply it to the section regarding queuing but given that you were out of the vehicle and the engine was turned off (thereby avoiding the offence of quitting) they would have a job to make it stick.

Could a punishment be imposed on you as an individual rather than applied to your driving license??

Maybe I am being silly in thinking I remember this but I thought that pedestrians aren't allowed on the motorway unless on the hard shoulder in an emergency, or something or other...

You're right. There are some exceptions, but I don't think any of them apply.

That is a separate non driving related offence, but the OP made no reference to being on a Motorway.

Sorry, you are right. the lower case "m" threw me.

But my comment still stands, it is a non driving offence for walking around on a Motorway
