Stuck in standstill traffic on the m2. Turned off vehicle, hand brake on exited car to use phone.
Is there any specific law that says this isn't allowed because im being told multiple different things.
are you allowed to exit your car in these situations. Obviously it's not recommended due to filtering motorcycles/ emergency vehicles. But is there an actual law that says its illegal to do this.
The short answer is that there is no specific law to cover the circumstances you describe however...
The law is quite clear with regards to using a mobile whilst in the vehicle, specifically a hand held device cannot be used when -
- stopped at traffic lights
- queuing in traffic
- supervising a learner driver
- driving a car that turns off the engine when you stop moving
- holding and using a device that's offline or in flight mode
A jobsworth apply it to the section regarding queuing but given that you were out of the vehicle and the engine was turned off (thereby avoiding the offence of quitting) they would have a job to make it stick.
