Motorcycle hit me as i was turning right.... Advice needed?

    A few weeks ago I was leaving work to head home, when i came out of my work car park to join a busy main road. I indicated to turn right and waited till someone let me out. After a few second a van stopped and flashed me out. I waved and edged out in front of him to check for traffic coming from my left. It was at that moment a motorcycle overtook the van on the outside and hit me in my front wing. He was okay and only really damaged my car. I had no way of seeing the motorcyclist coming omegle discord xender as my line of vision was blocked by the van. We exchanged details and I said i would call him once i had chance to access the damage. I called him a day later and he then told me he was refusing to take any blame as he was allowed to filter through traffic and I should have been looking right. I said that as we couldn't agree we should go through insurance which I contacted right away. Today I spoke to my insurance company and he has told them that i just pulled out at last minute in front of him. I told them about the Van which the motorcyclist hadn't mentioned and they asked me if I had a witness statement. Unfortunately he had driven off by the time i reversed and made sure biker was okay.

    However today I have managed to check CCTV from the front of my work premises which although doesn't show the accident itself. It does show the van stopping the traffic and the bike overtaking not only the van but also the cars behind the van at a fair speed before hitting me out of view from the camera. You can then see the aftermath of the biker going over road and us chatting whilst exchanging details. You can also see clearly a company logo on the side of the van, Which I am now confident i will be able to track down the van driver and for him to confirm he let me out and provide a statement to what happened.

    What do you think? If I can get a statement from the van driver, do you think i have strong case?

    I am afraid, the onus was on you to make sure it was safe to pull out, the van stopping still leaves you responsible for your actions.
    I would hand it over to your insurers, and let them sort it out.

    It sounds like you’ve got some solid evidence to support your case. If the CCTV footage clearly shows the van stopping to let you out and the motorcyclist overtaking at speed across multiple vehicles, that’s strong proof the biker was driving without due care. If you can track down the van driver and get a written statement confirming he stopped to let you out, it will strengthen your position significantly with your insurance. Make sure to save a copy of the footage (and back it up) before sharing it with your insurer. With both the video and a witness statement, you’ll have a much stronger case that the motorcyclist’s actions were the main cause of the accident.
